$2 Million Settlement In Diemel Wrongful Death Suit

A $2 million settlement in the Wrongful Death Suit filed by the families of Nick and Justin Diemel was approved by the Caldwell County Circuit Court.  The Diemel brothers traveled from Wisconsin to Braymer Missouri in July of 2019 to collect a $250,000 payment and went missing while on that trip.

The judgment against the defendants, Tommie Sue Feil of Braymer, J4S Farm Enterprises of Braymer and Garland Joseph Nelson of Braymer, includes paying the costs, expenses and or attorney fees.  The statement in the court records indicates the courts found the settlement is fair and reasonable under the circumstances and the settlement and distribution of the proceeds is fair and reasonable and settlement is in the best interests of the minor children of the plaintiffs.

Nelson has been charged in the death of the brothers and the criminal case continues in the courts.  At his arraignment, Nelson requested a change of judge.  Judge R. Brent Elliott approved the request and the Supreme Court has assigned Judge Kevin Walden, from the 8th Circuit Court, including Carroll and Ray Counties.
