A second appeal to the Missouri Supreme Court has failed for the family members of patients who died in 2002. The case, Sally Boland, Sherri Lynn Harper, David Gann, Jennirae Littrell and Helen Pittman versus Saint Luke’s Health System, Saint Luke’s Hospital of Chillicothe and Community Health Group, filed in 2016.
Lawyers for the families argued fraudulent concealment in the nature of the deaths.
The Respondents argued the family’s attorneys knew in 2010 and 2011 what they knew in 2016.
In the decision handed down Tuesday, the courts upheld the Circuit Court’s earlier decision that the statute of limitations on the case had run out and there was nothing new that would toll or extend the wrongful death statute of limitations.
