Probation For McElwee Rejected

A St. Joseph man, 45-year-old Nicholas Scott McElwee, was in Livingston County Court to consider probation on his conviction for Possession of a Controlled Substance.  McElwee had been sentenced to 7 years in prison and a 120-day program.  He completed the program and was order to appear for a hearing scheduled for Tuesday in Circuit Court to determine whether it would be an abuse of discretion to release the defendant on probation.

The court determined McElwee was not to be placed on probation and he was returned to prison to serve his remaining sentence of 7 years.
