Leatherman Communications, Inc. d/b/a KCHI Radio (“KCHI”, “we”, “us” or “our”) is committed to protecting your privacy. This Privacy Policy explains what personal information we collect through our website (including any mobile versions or apps, collectively the “Site”), how we use and share that information, and your rights regarding that information. By using the Site, you agree to the collection and use of information as described in this Privacy Policy.

Information We Collect

Information You Provide to Us: We collect personal information that you choose to provide directly, for example:

  • Contact Information: When you fill out forms on our Site – such as our general contact form, Trading Post submission form, Community Calendar event submission, or Advertiser Inquiry form – we may collect information like your name, email address, telephone number, and any other contact details you provide.

  • Content of Submissions: If you submit content to us to be publicized (for example, details of an item for sale for our “Trading Post” classifieds, or information about a community event), we collect the information included in your submission. This may include descriptions of the item or event, images or other details you choose to provide, and could also include personal contact information that you wish to be made public as part of the announcement. Please note: Any information you include in content submitted for public broadcast or posting (such as a phone number to be read on-air for a classified listing) will be disclosed publicly as part of that content, in accordance with your submission.

  • Other Communications: If you contact us by email, phone, or offline, or participate in any promotions or contests we offer, we will collect whatever information you choose to share with us (such as your name, contact information, and the content of your communication). This information is used to respond to and manage your request or participation.

Information Collected Automatically: Like most websites, our Site and our third-party analytics and advertising partners collect certain information about your visit automatically, through cookies, pixels, and similar tracking technologies. This usage data may include:

  • Technical Identifiers: Your IP address, device type, browser type, operating system, and other device identifiers, which are automatically captured when you access our Site.

  • Usage Details: Information about how you use our Site, such as the pages or content you view, the dates/times of your visits, the referring page (the webpage that led you to our Site), and your navigation and interactions on the Site (e.g. clicks, scrolling, mouse movements). For example, we use Google Analytics, which uses first-party cookies to track visitor interactions with our Site. This helps us understand metrics like which pages are most popular, how users move through the Site, and other usage patterns.

  • Cookies and Tracking Technologies: Small data files like cookies or pixels may be stored on your device to remember your preferences and track your activity online. We generally do not collect sensitive personal information via the Site (such as Social Security numbers or financial account numbers), and we do not intentionally collect any information from children under 13 (see Children’s Privacy below).

How We Use Your Information

We use the personal and usage information collected for the following purposes:

  • To Provide Services and Information You Request: We use the information you submit to carry out the services or actions you have requested. For example, if you submit a Trading Post item or community event, we use the details you provide to produce the on-air announcement and/or post the information on our Site as intended. If you fill out a contact form or advertiser inquiry, we use your contact details and message to respond to your inquiry or provide the requested information.

  • To Operate and Improve Our Website: We process usage data and feedback to understand how our Site is used and to make improvements. Your information helps us troubleshoot technical issues, analyze Site performance, and develop new features or content that better serve our audience. For instance, our analytics tools (like Google Analytics and Microsoft Clarity) gather data on user interactions and website behavior, which we review to improve the user experience and content offerings.

  • Analytics and Audience Measurement: We use third-party analytics services to collect information about traffic and usage patterns on our Site. This helps us measure our audience size and demographics, understand which content is most engaging, and evaluate the effectiveness of any features or campaigns. For example, Google Analytics uses cookies to generate reports on Site visitors (while prohibiting the collection of personally identifiable information). Microsoft Clarity captures behavioral metrics like clicks, scrolls, and “heatmaps” of user interactions via session recordings. These analytics tools provide us aggregated insights (not individual profiling) that we use to tailor our content and services to listener interests.

  • Advertising and Marketing Purposes: We may use information about your visits and interactions to help deliver relevant advertising and promotions, both on our Site and elsewhere. For example, we may in the future utilize online advertising networks or tools like the Facebook (Meta) Pixel to help us “retarget” our audience with promotional messages on other platforms. The Facebook/Meta Pixel is a piece of code on our Site that can track visitor behavior (such as pages viewed or links clicked) and report it to Meta (Facebook). This helps us measure the effectiveness of our ads and reach people who have shown interest in our content. Data collected through the Meta Pixel may include information like your IP address, browser type, and pages you visited. Meta can potentially associate this data with your profile on their platform to personalize the ads you see. We use such tracking technologies to assist in our marketing efforts (for example, to let you know about our station’s events or offerings via ads on Facebook or similar platforms). Please note: Where required by law, we will obtain your consent before using non-essential cookies or pixels for advertising. You can also opt-out of certain targeted advertising – see Your Rights and Choices below.

  • Communication: We may use your contact information to communicate with you. This includes responding to messages you send us, sending confirmations or information related to content you submitted (e.g., confirming we received your event submission), or contacting you with important announcements about the Site or our services. We will not send you marketing emails or newsletters unless you have agreed to receive them.

  • Legal Compliance and Protection: We may process and retain your information as needed to comply with applicable laws and regulations or to respond to lawful requests and legal process. We also use and disclose information as necessary to enforce our Site’s terms and conditions, to resolve disputes, to prevent fraud or abuse, or to protect the rights, safety, and property of KCHI, our employees, our users, or the public. For example, if you enter information as part of a contest or promotion, we may use it to ensure compliance with contest rules and may disclose winner information as required by law.

Cookies and Tracking Technologies

Cookies and Similar Technologies: Our Site uses “cookies” and similar tracking technologies (such as web beacons, pixels, and scripts) to enhance your experience and enable certain functionality. Cookies are small text files placed on your device when you visit a website. They allow the site to recognize your browser and remember information about your visit (e.g., your preferences or whether you are a returning visitor). We use these technologies for several reasons:

  • Essential Functions: Some cookies are necessary for the Site to function properly (for example, to enable playback of streaming audio or to allow you to submit forms without re-entering information).

  • Analytics: We use analytics cookies and scripts to collect information about how visitors use our Site. For instance, Google Analytics sets first-party cookies to compile reports on user activity, helping us understand things like how long users stay on a page, what pages are visited most, and how users are finding our Site. Microsoft Clarity uses both first-party and third-party cookies and similar technologies to capture detailed information about user interactions (e.g., mouse movements, clicks, scroll depth) and to generate aggregated insights like heatmaps or session replays. These tools help us analyze website traffic and usage patterns so we can improve site performance and content. (Google Analytics may also collect certain information such as IP address and device identifiers, but Google’s policies prohibit sending personally identifiable info through Analytics. Microsoft Clarity likewise masks or does not retain any directly identifying information like names – it focuses on behavioral data.)

  • Advertising and Social Media Pixels: We utilize tracking pixels (snippets of code) from third parties to assist with advertising and social media integration. In particular, our Site uses the Meta (Facebook) Pixel. The Meta Pixel works by sending information about your visit to Facebook/Meta, which helps us show you relevant ads on Facebook or Instagram after you’ve visited our Site. For example, if you visit pages on our Site, the Pixel will note that activity; we can then create advertising campaigns to display our station’s promotions or content to people who visited our Site when they later browse Facebook. The Meta Pixel can collect data such as the pages you viewed, your IP address, browser and device information, and timestamps. Meta may combine this data with information it has about you to create a profile of your interests for ad targeting. We only use the Meta Pixel in accordance with applicable privacy laws – for instance, obtaining consent if required.

  • Other Third-Party Tools: We may integrate other third-party services that set cookies or use similar technologies. For example, if we embed a video player, map, or social media feed on our Site, those providers may set cookies. Currently, our Site links to our social media pages (e.g., Facebook, Twitter) and provides a streaming audio player (which may be powered by a third-party service); these external services might use cookies or tracking subject to their own policies.

Your Choices for Cookies: On your first visit to our Site, you may see a cookie consent notice (if required by law) giving you options to allow or disable certain cookies. Regardless, you can control cookies through your browser settings. Most web browsers allow you to refuse new cookies, delete existing cookies, or be notified before a cookie is set. Please note that if you disable or delete cookies, some features of our Site (such as remembering your preferences or keeping you logged in, if applicable) may not work properly.

For analytics cookies, Google provides an opt-out browser add-on that you can install to prevent Google Analytics from collecting data on any website. For interest-based advertising via cookies, you can also use industry opt-out tools from the Network Advertising Initiative (NAI) or the Digital Advertising Alliance (DAA) in the U.S., or the Your Online Choices site if you are in the EU. Adjusting your Facebook ad preferences can control how Meta uses information collected via the Pixel for targeting ads to you. Keep in mind that opting out of targeted advertising cookies does not mean you will no longer see ads – but the ads may be less relevant to your interests.

How We Share and Disclose Information

We value your privacy. Accordingly, we do not sell your personal information to third parties for their own commercial use. However, we do share certain information with third parties in the following circumstances, and as otherwise described in this Privacy Policy:

  • With Service Providers and Partners: We share information with trusted third-party service providers who perform functions on our behalf to keep our Site and services running smoothly. This includes, for example, website hosting companies, IT support and security vendors, analytics providers (such as Google and Microsoft, as noted above), and other technical partners who help operate or analyze the Site. These service providers are given access only to the information necessary for them to perform their specific services, and we contractually require them to protect your information and use it only for our purposes. For instance, when we use Google Analytics or Microsoft Clarity, the data about your site usage is transmitted to Google or Microsoft for processing into reports for us. Similarly, if we utilize an email service to manage contact form submissions or an ad network to display ads, those parties will handle your data under our instructions. We also may partner with advertising networks or social media platforms (like Meta/Facebook) to reach our audience with ads, which involves sharing certain pseudonymous identifiers or pixel data as described above.

  • With Your Consent or At Your Direction: We will share your information with third parties if you specifically request or consent to such sharing. For example, if you submit a Trading Post listing or community event and ask us to broadcast or publish certain contact details (such as your phone number for interested buyers to reach you), we will make that information public as part of fulfilling your request. Likewise, if we run a promotion co-sponsored by another organization and you choose to enter, we might ask for your consent to share your entry information with the co-sponsor.

  • Public Disclosure of Submitted Content: As noted, content you submit for public posting or broadcast will be shared publicly. This means that, for example, if you send us a classified ad to read on-air and post online, any personal information within that ad (like your name or phone number in the ad’s text) will be available to our audience on the radio and/or website. Please only include information in those submissions that you are comfortable being made public. We are not responsible for how listeners or website visitors might use information (such as a phone number) that you have chosen to make public via our services.

  • Legal Compliance and Protection: We may disclose information about you if required to do so by law or legal process, or if we have a good-faith belief that such disclosure is necessary to comply with applicable laws, regulations, or legal requests. This includes responding to subpoenas, court orders, or lawful requests by government authorities. We may also share information as necessary to enforce our own legal rights or contractual agreements, to investigate or assist in preventing fraud or security issues, or to protect the rights, property, and safety of KCHI, our employees, our users, or the public.

  • Business Transfers: If KCHI or Leatherman Communications, Inc. is involved in a merger, acquisition, sale of assets, or other business reorganization (or in the unlikely event of bankruptcy or receivership), your personal information may be transferred to the successor or acquiring entity as part of that transaction. In such cases, we will ensure that your information remains protected by this Privacy Policy (unless, and until, it is replaced by an updated privacy policy).

  • Aggregate or De-Identified Information: We may share information that has been aggregated or anonymized (so it does not identify you personally) with third parties for any legitimate business purpose. For example, we might share general statistics about our website traffic or listener demographics with potential advertisers or partners. Such information will not include any personally identifiable details.

Apart from the situations listed above, KCHI will not disclose your personal information to third parties without your consent. We do not share your personal data with third parties for their own direct marketing purposes unless you have given us permission. In particular, we do not rent or sell our email lists or other contact info to unrelated companies for marketing.

Data Retention

We retain personal information only for as long as necessary to fulfill the purposes described in this Privacy Policy or as required or permitted by law. The length of time we keep information depends on the type of data and the purpose for which we collected it:

  • User Submissions and Content: If you submit content (e.g. a Trading Post listing or event announcement), we may retain that content on our Site or archives for a period of time. Public posts on our website (if any) may remain visible until we remove them in accordance with our internal schedule or at your request (if applicable). Broadcast content (e.g., an on-air announcement) may not be retrievable once aired, but any records of it will be kept according to our standard retention policies (for example, we may keep logs or recordings of broadcasts for a certain period as required by FCC regulations or internal policy).

  • Contact Information and Inquiries: If you contact us or submit an inquiry (including advertiser inquiries), we will retain your contact information and correspondence for as long as needed to respond and for a reasonable time thereafter, in case further follow-up is necessary. We may keep a record of business-related communications (with advertisers or partners) for our records.

  • Analytics Data: Data collected via analytics tools (Google Analytics, Microsoft Clarity, etc.) is stored by those providers and subject to their retention policies. Google Analytics, for instance, allows us to set retention periods for user-level data; we will configure these settings in line with our needs, but generally analytics data may be retained for 26 months or another standard period to allow year-over-year comparisons and trend analysis. Microsoft Clarity’s recordings and data are similarly retained for a limited time (Clarity’s default retention is typically 30 days for recordings, unless otherwise configured). We use aggregated analytics reports for ongoing analysis, but those reports do not contain personal identifiers.

  • Legal Obligations and Disputes: We may need to retain certain information for longer periods if required by law (e.g., records needed for tax, accounting, or regulatory purposes) or if needed to resolve disputes or enforce our agreements. For example, if you engage in a contest or promotion, we might retain your entry information for the duration of the contest and any applicable retention period after its conclusion.

When we no longer have a legitimate need or legal obligation to keep your personal information, we will securely delete or anonymize it. If deletion is not feasible (for example, because the data is stored in backup archives), we will isolate it from further processing until deletion is possible.

Data Security

We have implemented commercially reasonable administrative, technical, and physical security measures to protect your personal information from unauthorized access, disclosure, alteration, and destruction. These measures include safeguards such as firewall and encryption technologies, secure socket layer (SSL) for data transmission on sensitive pages, regular security assessments, and restricted access to personal data on a need-to-know basis. For example, if we were to collect sensitive information like credit card numbers, such transmissions would be encrypted and handled over secure connections. We also maintain procedural safeguards to limit access to personal information; for instance, only authorized station personnel and contractors who need the data to perform their duties will have access to it, and they are bound by confidentiality obligations.

While we strive to protect your information, no method of transmission over the Internet or electronic storage is 100% secure. Therefore, we cannot guarantee absolute security of your data. You should take care in deciding what information you send to us electronically, and understand that there is always some risk involved. In the event of a data breach or security incident affecting your personal information, we will notify you and the appropriate authorities as required by law.

We also encourage you to protect your own information. Make sure you use strong, unique passwords for any accounts (if any) and be cautious about sharing personal data in public forums on our Site. (Currently, our website does not offer public commenting features, which reduces some security risk, but general caution is always advisable.)

Children’s Privacy

Our Site and services are intended for a general audience and are not directed to children under the age of 13. We do not knowingly collect personal information from children under 13 years of age. If you are under 13, please do not submit any personal information to us (for example, do not fill out forms or provide your name or contact details). If we discover that we have inadvertently collected personal information from a child under 13 without appropriate consent, we will take immediate steps to delete that information from our records.

Parents or guardians: if you believe that your child under 13 may have provided personal information to us through our Site, please contact us using the information in the Contact Us section below. We will promptly investigate and remove the data if found.

(Note: We may cover local school events or youth activities as part of our radio news content, but that reporting does not entail collecting personal data from children via our website. Any information about minors that might be broadcast e.g., the name of a student athlete in a sports report is gathered through journalistic means and not via children providing it through the Site. Such content is handled in accordance with standard media practices and not used for commercial purposes.)

For teens under the age of 18, we recommend obtaining permission from a parent or guardian before submitting any information to us, although our primary restriction is for those under 13 as defined by the Children’s Online Privacy Protection Act (COPPA). We also abide by applicable privacy laws that provide additional protections for minors (for example, certain states’ laws protecting the data of consumers under 16).

Your Rights and Choices

You have certain rights and choices regarding your personal information. These may vary depending on your location (for example, residents of California or the European Union have specific legal rights, which we outline below), but we are committed to enabling all our users to exercise meaningful control over their data.

Access and Correction: You have the right to request access to the personal information we hold about you and to request corrections of any inaccuracies. If you have submitted information to us (such as through a contact form or other submission) and you would like to review it, update it, or correct it, please contact us. We will honor reasonable requests to access and amend data we have about you. For example, if you provided an incorrect phone number in a Trading Post submission and need to correct it, you can reach out and we will update our records or the public post as feasible.

Deletion of Personal Information: You have the right to request that we delete personal information we have collected from you, subject to certain exceptions under the law. This is sometimes called the “right to be forgotten.” Upon receiving a verified deletion request, we will remove or anonymize the personal information we hold about you, unless an exception applies (for instance, if we are legally required to keep certain data, or if the information is needed to complete a transaction you requested or to exercise our rights). Please note that if you request deletion of information that you asked us to make public (such as a classified listing), we can remove the information from our website going forward, but we cannot undo any broadcast that has already occurred, and search engines or other parties may retain archives of our website content beyond our control. We will, however, make good-faith efforts to delete what we control and to inform third-party processors to delete data where applicable. To request deletion, please contact us using the details in the Contact Us section. For your security, we may take steps to verify your identity before fulfilling a deletion or access request (for example, by asking you to confirm details we already have on file).

California Privacy Rights: If you are a resident of California, you are entitled to specific disclosures and rights under the California Consumer Privacy Act (CCPA) as amended by the California Privacy Rights Act (CPRA). These include the right to know what categories of personal information we collect and for what purposes, the categories of sources of that information, the categories of third parties with whom we share personal information, and whether we disclose it for “business purposes” or “sell” it. We have provided details of our practices in this Privacy Policy (and we reiterate that we do not sell personal information to third parties in exchange for money). If you are a California resident and wish to exercise your right to know, access, or delete your personal information, you may contact us with your request. Additionally, California’s “Shine the Light” law (Civil Code § 1798.83) allows you to request information about any disclosure of your information to third parties for their direct marketing purposes. Since we do not share your personal information with unaffiliated third parties for their own direct marketing without consent, our response to such requests will reflect that. Nonetheless, you can send such inquiries to us and we will respond in accordance with applicable law.

GDPR and International Users: If you are located in the European Economic Area (EEA), the United Kingdom, or other regions with data protection laws (like the GDPR) granting you rights, you may have the following rights (in addition to those listed above): the right to object to or restrict processing of your data, the right to data portability, and the right to lodge a complaint with a supervisory authority. We do not actively target our services to EU users, but if you happen to visit from the EU and wish to exercise any GDPR rights, please contact us. We will evaluate and respond to such requests in accordance with applicable law. Also, note that by using our Site, your information will be transferred to and processed in the United States (where our company and servers are located). For the Meta/Facebook Pixel, you can adjust your Facebook ad settings or use browser-based blocking tools. Some browsers offer Do Not Track (DNT) signals; however, there is currently no industry standard for recognizing or honoring DNT signals, so our Site does not respond to these signals. Instead, use the opt-out methods described if you wish to reduce online tracking. (As of the date of this Policy, we do not alter our data collection in response to DNT because no uniform standard exists for doing so).

No Discrimination: We will not discriminate against you for exercising any of your privacy rights. For example, we will not deny you services, charge you different prices, or provide a lesser user experience because you exercised your rights under applicable privacy laws.

Managing Public Information: If we host any publicly accessible content (like comments sections or classified listings), you may request removal of your personal information from those areas. Where possible, we will remove or anonymize such information at your request. (If the content is user-generated, you might also be able to log into your account and delete or edit it yourself – though note, currently our website does not have public commenting features). For any content that has been made public, we cannot guarantee complete removal from the internet (for example, others may have copied the content or it may be archived elsewhere), but we will do our best to remove it from our Site.
