Family Of Truck Driver Settles With BNSF In Wrongful Death Lawsuit

The family of the truck driver involved in the Amtrak derailment near Mendon in June of 2022 has reached a court-approved settlement in the wrongful death case filed against BNSF Railway Company.

Under the settlement, the family of Billy Dean Barton II, the driver of the dump truck who died in the crash, will receive an undisclosed settlement.  This includes his wife, Erin Barton, and five adult children.

Under the settlement, Erin Barton waives the right to a jury trial and the right to appeal.
