A St. Joseph man, 45-year-old Nicholas Scott McElwee, was booked into the Caldwell County Detention Center on a Writ to appear in Livingston County Court on a charge of possession of a Controlled Substance. McElwee had been convicted and sentenced to 7 years in prison and a 120-day program. He completed the program and is to appear for a hearing scheduled for today (Tuesday) in Circuit Court to determine whether it would be an abuse of discretion to release the defendant on probation.
