Variance Denial May End Up In Court

A Chillicothe woman who followed the process to place a home on her property has been told she must remove it.  Taylor West, a Sergeant with the Livingston County Sheriff’s Department, began the process in 2024, working with a local business to purchase and place a manufactured home at 97 Garr Field Avenue.  West says they applied for and received the building permits needed.

Building Permit Received 12-31-24 and Certificate of Occupancy received on 2-12-25.

The Building Permit was approved by Heather Gates.  The permit had special provisions requiring a cement or block wall around the perimeter of the building.  There was also a provision requiring a 24-hour notice prior to moving the home.

West says that after living in the home over the summer, she received a notice from the city.

Received the letter from the City Attorney that the home was not
allowed in the zoning district, and she had one year to remove it.

West states that she has tried working with the city to resolve the issues, with the latest step of requesting a variance, which was rejected by the Board of Zoning Adjustments.

West says they have 30 days to appeal the decision, and they plan to take the city to court.

The City Codes office was contacted by KCHI for comment, but the call was not returned by mid-afternoon Tuesday.  City Attorney Robert Cowherd was also contacted and had no comment at this time.
